Terms of Service for Benster
Effective date: September 21, 2026
These Terms of Service (“Terms”) govern your use of the Benster mobile application, website, waitlist, and beta program (collectively, the “Services”), operated by JP4 LABS LLC (“we,” “us,” or “our”).
Please read these Terms before using the Services. By using the Services, you agree to these Terms. If you do not agree, please do not use the applicable Service.
1. About Benster
Benster provides timed math practice, answer reviews, practice history, personal bests, streaks, and related features.
Benster is intended to supplement learning and encourage regular practice. It is not a substitute for instruction from a teacher or qualified education professional.
Features may change as Benster develops.
2. Children, Adult Supervision, and Parental Gate
Benster is designed for math learners, including children.
If a learner is not legally able to agree to these Terms, a parent or legal guardian must review and agree to them before permitting the learner to use Benster. Parents and guardians are responsible for appropriate supervision.
Benster requires a parental math challenge before accessing:
Reset practice defaults.
Delete all saved data.
The external Privacy Policy link.
The external Terms of Service link.
The parental gate is intended to encourage adult involvement. It does not verify a person’s age or identity, guarantee that children cannot access these actions, or replace adult supervision.
Completing the gate does not, by itself, constitute acceptance of these Terms or consent to collect personal information.
Our website waitlist, support communications, and beta-feedback channels are intended for adults. Children should not submit their own email address, full name, photographs, school information, or other personal information through these channels.
3. Waitlist Communications
Joining the Benster waitlist is optional.
When you subscribe, you request the Benster-related communications described at signup, such as launch announcements, availability updates, product news, or beta-testing opportunities.
Provide only an email address that belongs to you or that you are authorized to use. You can unsubscribe using the link included in marketing emails or by contacting us.
Joining the waitlist does not guarantee beta access, a release date, particular features, or specific pricing. It does not create a paid subscription or purchase obligation.
4. TestFlight Beta Testing
Benster may be available as prerelease software through Apple TestFlight.
Beta software may contain bugs, incomplete features, inaccurate results, interruptions, or compatibility problems. Updates or technical failures may affect locally stored information.
Do not rely on a beta version as your only record of important information. Beta access may expire or be changed or discontinued as testing progresses.
Participation is also subject to Apple’s TestFlight Terms and Conditions, including Apple’s eligibility requirements.

5. Local Practice Information and Deletion
The current app stores your nickname, preferences, and practice records locally on your device. It does not provide an online account or developer-operated cloud synchronization.
We cannot remotely access or recover your local practice records. Deleting saved data, removing the app, device loss, or technical problems may result in loss of information. Device backups depend on your device settings and backup provider.
You can manage your nickname, preferences, and saved data in Settings.
To delete local app information, select Settings → Saved data → Delete all saved data, complete the parental gate, and select Delete Everything in the final confirmation.
This removes your nickname, saved preferences, onboarding completion status, sprint history, personal bests, and records used to calculate streaks from the app’s local storage. This action cannot be undone within Benster.
Selecting Reset practice defaults also requires completing the parental gate and confirming the reset. It resets practice settings without deleting your nickname or progress.
Deleting information in the app does not necessarily remove copies in existing device backups. See our Privacy Policy for additional details.
6. Acceptable Use
Use Benster and its website lawfully and without interfering with others or the Services.
You may not:
Attempt unauthorized access to our systems.
Introduce malware or deliberately disrupt the Services.
Impersonate JP4 LABS LLC or misrepresent your affiliation with us.
Copy, redistribute, sell, or commercially exploit our software or content without authorization.
Use our branding or mascot in a way that infringes our rights or falsely suggests our endorsement.
Use automated tools to disrupt the website or extract content in violation of applicable law or our rights.
These restrictions do not limit activities permitted by applicable law, the applicable app license, or relevant third-party licenses.
7. Ownership and App License
Benster’s original software, branding, mascot artwork, illustrations, designs, and content are owned by or licensed to JP4 LABS LLC. Using the Services does not transfer ownership of those materials to you.
These Terms do not give us ownership of your personal information or locally stored practice records.
For versions distributed through the Apple App Store, the app license is governed by Apple’s Standard Licensed Application End User License Agreement unless we expressly provide a separate applicable license.
These Terms supplement, rather than replace, the applicable app license. If there is a conflict concerning the app license, that license controls. Third-party and open-source components remain subject to their respective licenses.
8. Feedback
If you voluntarily provide suggestions, ideas, or bug reports, you permit us to use them to evaluate and improve Benster without compensation to you.
This permission does not authorize us to publicly disclose personal information or override restrictions applicable to TestFlight feedback.
Please avoid including confidential information, sensitive information, or unnecessary information about a child. Personal information in feedback is handled as described in our Privacy Policy.
9. Privacy and Third-Party Services
Our Privacy Policy explains local app storage, parental-gate answer handling, website and waitlist information, support communications, TestFlight information, and privacy choices.
We use third-party services, including Hostinger for website hosting, Loops for waitlist communications, and Apple for app distribution and beta testing.
The Privacy Policy and Terms of Service links in Settings open our website after the parental gate is completed.
Your use of independently operated third-party services may be subject to their terms and privacy policies. We do not control those services, but this does not remove our responsibilities under applicable law.
10. Educational Results and Availability
Benster’s questions, scores, timing, levels, and streaks are intended for practice and encouragement. They are not formal educational assessments.
We do not guarantee particular academic outcomes, alignment with every curriculum, or that every question or result will be error-free.
We aim to provide a reliable experience, but cannot guarantee uninterrupted availability or compatibility with every device or operating-system version.
We may update or discontinue features or beta access, subject to applicable law. You may stop using the Services at any time.
11. Disclaimers and Liability
To the extent permitted by applicable law, the Services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the extent those warranties may lawfully be disclaimed.
To the extent permitted by applicable law, JP4 LABS LLC will not be liable for indirect, incidental, special, or consequential damages arising from use of, or inability to use, the Services.
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, or any liability that cannot lawfully be excluded or limited. Nothing removes mandatory consumer rights or remedies.
12. Changes to These Terms
We may update these Terms as Benster develops. We will post the revised Terms on this page and update the effective date.
For material changes, we will provide appropriate notice and obtain agreement where required by applicable law. Posting revised Terms does not override any legally required notice or agreement process.
If you do not agree to revised Terms, you may stop using the applicable Service.
13. Governing Law
These Terms are governed by Florida law and applicable United States federal law, except where mandatory law requires otherwise.
This choice of law does not remove consumer protections or other rights that apply where you live.
If a provision is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
