Terms of Service for Benster

Effective date: August 29, 2026

These Terms of Use (“Terms”) are an agreement between you and JP4 LABS LLC (“we,” “us,” or “our”), the operator of the Benster mobile application, website, waitlist, and beta program.

By accessing or using Benster or its website, you agree to these Terms. If you do not agree, please do not use the applicable service.

1. About Benster

Benster is an educational application that provides timed math practice, progress tracking, practice history, and related features.

Benster is intended to supplement math practice. It is not a school, tutoring service, or substitute for instruction from a qualified teacher or education professional.

We may update, modify, suspend, or discontinue features as Benster develops.

2. Children and Adult Supervision

Benster is designed for math learners, including children.

A parent or legal guardian should authorize and supervise a child’s use of the app. If you permit a child to use Benster, you accept these Terms on the child’s behalf and are responsible for supervising that use.

The Benster website waitlist, support channels, and beta-feedback channels are intended for parents, guardians, educators, and other adults. Children should not submit their own email address, full name, contact information, school information, photographs, or other personal information.

3. Waitlist Communications

You may voluntarily provide an email address to join the Benster waitlist.

By joining, you request to receive Benster-related communications from JP4 LABS LLC, such as:

  • Waitlist confirmation.

  • Launch and availability announcements.

  • Beta-testing opportunities.

  • Product updates and news.

Joining the waitlist does not guarantee beta access, availability, a particular release date, specific features, or specific pricing.

You must provide an email address that belongs to you or that you are authorized to use. You may unsubscribe at any time by using the unsubscribe link included in an email or by contacting us.

4. Beta Software

Benster may be made available as prerelease software through Apple TestFlight.

Beta software may contain bugs, incomplete features, interruptions, inaccuracies, or other problems. Features and locally stored information may change or be lost during testing.

You should not rely on a beta version for permanent recordkeeping. We may modify, suspend, expire, or discontinue beta access at any time.

Use of TestFlight is also subject to Apple’s applicable terms.

5. Acceptable Use

You agree to use Benster and its website only for lawful purposes.

You may not:

  • Attempt to gain unauthorized access to the Service or related systems.

  • Interfere with the operation, availability, or security of the Service.

  • Introduce malware, harmful code, abusive traffic, or automated attacks.

  • Scrape or automatically extract website or app content without permission.

  • Copy, sell, sublicense, or commercially exploit Benster or its content.

  • Misrepresent your identity or affiliation with JP4 LABS LLC.

  • Use Benster’s name, mascot, artwork, or branding without permission.

6. Ownership

Benster’s software, designs, branding, mascot artwork, illustrations, text, graphics, and original content are owned by or licensed to JP4 LABS LLC and are protected by applicable intellectual-property laws.

Using Benster does not transfer ownership of the app or its content to you. All rights not expressly granted are reserved.

7. Feedback

If you voluntarily provide ideas, suggestions, or bug reports, you permit JP4 LABS LLC to use that feedback to evaluate and improve Benster without compensation or obligation to you.

Please do not include confidential information, sensitive information, or unnecessary information about a child in feedback.

Personal information included in feedback is handled according to the Benster Privacy Policy.

8. Privacy

Our handling of information is described in the Benster Privacy Policy, including:

  • Information stored locally by the app.

  • Information collected through the website waitlist.

  • TestFlight and support information.

  • Retention and deletion practices.

  • Available privacy choices.

The Privacy Policy is available on the Benster website and through an accessible location inside the app.

9. App License and Third-Party Services

Unless JP4 LABS LLC provides a custom license agreement, the license for the Benster iOS application is governed by Apple’s Standard Licensed Application End User License Agreement and applicable App Store rules.

Benster may use or link to third-party services, including Apple TestFlight, the Apple App Store, website-hosting providers, email providers, and Loops for waitlist communications.

Those services operate under their own terms and privacy policies. JP4 LABS LLC does not control their independent services or practices.

10. Educational Results and Availability

Scores, streaks, timing information, difficulty levels, and other results are provided for general practice and encouragement.

We do not guarantee that:

  • Every question or result will be error-free.

  • Scores precisely measure a learner’s ability.

  • Using Benster will produce a particular academic result.

  • Benster will align with every school or curriculum.

  • The Service will always be available, uninterrupted, or error-free.

Parents, guardians, educators, and learners should use reasonable judgment when interpreting practice results.

11. Disclaimer and Limitation of Liability

To the maximum extent permitted by applicable law, Benster and its website are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability.

To the maximum extent permitted by applicable law, JP4 LABS LLC and its members, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of or inability to use Benster.

Nothing in these Terms limits legal rights or remedies that cannot lawfully be excluded or limited.

12. Changes to These Terms

We may update these Terms as Benster develops.

When changes are made, we will post the revised Terms and update the effective date. If a change is material, we will provide additional notice where reasonably appropriate or required by law.

If you do not agree with revised Terms, you should stop using the applicable Service.

13. Governing Law

These Terms are governed by the laws of the State of Florida and applicable United States federal law, without regard to conflict-of-law principles.

Nothing in these Terms removes mandatory consumer protections that apply where you live.
